Common use of Negotiated Terms Clause in Contracts

Negotiated Terms. No fee, expense reimbursement, or payment term of the Agreement, including the Base Hourly Rate, is set by New York, California, or any other law. Rather, all terms of the Agreement are subject to negotiation between the parties and represent the voluntary and mutual understanding and agreement of the parties. 18 Fee Arbitration Notwithstanding the foregoing, if a dispute arises between the parties relating to Attorney’s fees, Client may have the right to arbitration of the dispute pursuant to Part 137 of the Rules of the Chief Administrator of the Courts of the State of New York. Attorney will provide to Client a copy of such rule upon request.
