NET EFFECTIVE GENERATING CAPACITY Clause Samples

The Net Effective Generating Capacity clause defines the actual, usable output capacity of a power generation facility after accounting for factors such as maintenance, outages, and operational limitations. In practice, this clause specifies how the effective capacity is calculated, often by subtracting unavailable or derated capacity from the facility’s total installed capacity, and may set standards for measurement or reporting. Its core function is to provide a clear and agreed-upon basis for determining the amount of electricity that can reliably be delivered, thereby ensuring transparency and fairness in performance obligations and contractual settlements.
