Common use of Network Interface Device Clause in Contracts

Network Interface Device. 9.1 Subject to the conditions set forth in Section 1 and at Z-Tel’s request, Verizon shall permit Z-Tel to connect a Z-Tel Loop to the Inside Wiring of a Customer through the use of a Verizon NID in the manner set forth in this Section 9. Verizon shall provide Z-Tel with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel may access a Verizon NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel NID deployed by Z-Tel or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it 9.2 In no case shall Z-Tel access, remove, disconnect or in any other way rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Z-Tel access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Z-Tel remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Z-Tel remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). When Z-Tel is connecting a Z-Tel-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel does not need to submit a request to Verizon and Verizon shall not charge Z-Tel for access to the Verizon NID. In such instances, Z-Tel shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 of this Agreement. 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means: 9.7.1 Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel may request Verizon to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-Tel, its agent, the building owner or the Customer). If Z-Tel accesses the Customer’s Inside Wire as described in this Section 9.7.2, time and materials charges will be billed to the requesting party (i.e. Z-Tel, its agent, the building owner or the Customer).

Z-Tel Intrado may access a Verizon NID either by means of a Cross Connection connection (but only if the use of such Cross Connection connection is technically feasible) from an adjoining Z-Tel Intrado NID deployed by Z-Tel Intrado or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel an Intrado Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Z-Tel Intrado access, remove, disconnect or in any other way rearrange, rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Z-Tel Intrado access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Z-Tel Intrado remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Z-Tel Intrado remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire Wiring must be resolved by the person who controls use of the wire wiring (e.g., the Customer). . 9.7 When Z-Tel Intrado is connecting a Z-Telan Intrado-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel Intrado does not need to submit a request to Verizon and Verizon shall not charge Z-Tel Intrado for access to the Verizon NID. In such instances, Z-Tel Intrado shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement Attachment and shall access the Customer’s Inside Wire in the manner set forth in Section 7 9.8 of this AgreementAttachment. 9.7 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel Intrado may access the Customer’s Inside WireWiring, acting as the agent of the Customer by any of the following means: 9.7.1 9.8.1 Where an adequate length of Inside Wire Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Z-Tel Intrado may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel 9.8.3 Intrado may request Verizon to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelIntrado, its agent, the building owner or the Customer). If Z-Tel Intrado accesses the Customer’s Inside Wire Wiring as described in this Section 9.7.29.8.3, time and materials charges will be billed to the requesting party (i.e. Z-TelIntrado, its agent, the building owner or the Customer).

Verizon shall provide Z-Tel with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel SPRINT may access a Verizon VERIZON NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel SPRINT NID deployed by Z-Tel SPRINT or, if an entrance module is available in the Verizon VERIZON NID, by connecting a Z-Tel SPRINT Loop to the Verizon VERIZON NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon VERIZON will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. The Customer shall be responsible for resolving any conflicts between service providers for access to the Customer’s premises and Inside Wire. 9.2 1.3.2 In no case shall Z-Tel SPRINT access, remove, disconnect or in any other way rearrange, Verizonrearrange VERIZON’s Loop facilities from VerizonVERIZON’s NIDs, enclosures, or protectors. 9.3 1.3.3 In no case shall Z-Tel SPRINT access, remove, disconnect or in any other way rearrange, rearrange a Customer’s Inside Wire from VerizonVERIZON’s NIDs, enclosures, or protectors where such Customer Inside Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 1.3.4 In no case shall Z-Tel SPRINT remove or disconnect ground wires from VerizonVERIZON’s NIDs, enclosures, or protectors. 9.5 1.3.5 In no case shall Z-Tel SPRINT remove or disconnect NID modules, protectors, or terminals from VerizonVERIZON’s NID enclosures. 9.6 1.3.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). . 1.3.7 When Z-Tel SPRINT is not connecting a Z-TelSPRINT-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon VERIZON NID, Z-Tel SPRINT does not need to submit a request to Verizon VERIZON and Verizon VERIZON shall not charge Z-Tel SPRINT for access to the Verizon VERIZON NID. In such instances, Z-Tel SPRINT shall comply with the provisions of Sections 9.2 1.3.2 through 9.7 1.3.6 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 1.3.7.1 of this Agreement. 9.7 1.3.7.1 Due to the wide variety of NIDs utilized by Verizon VERIZON (based on Customer size and environmental considerations), Z-Tel SPRINT may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means:. 9.7.1 (a) Where an adequate length of Inside Wire is present and environmental conditions permit, requesting carrier (i.e., SPRINT or SPRINT's agent, the building owner, or the Customer) may remove the Inside Wire from the Customer’s side of the VERIZON NID and connect that wire to SPRINT’s NID. (b) Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel SPRINT may enter the Customer side of the Verizon VERIZON NID enclosure for the purpose of removing the Inside Wire from the terminals of VerizonVERIZON’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon VERIZON NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon VERIZON NID. 9.7.2 Z-Tel (c) SPRINT may request Verizon VERIZON to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelSPRINT, its agent, the building owner or the Customer). If Z-Tel SPRINT accesses the Customer’s Inside Wire as described in this Section 9.7.21.3.7.1(c), time and materials charges will be billed to the requesting party (i.e. Z-TelSPRINT, its agent, the building owner or the Customer).

Network Interface Device. 9.1 11.3.1 Subject to the conditions set forth in Section 1 11.7, and at Z-Tel’s requestthe request of Mpower, Verizon BA shall permit Z-Tel Mpower to connect a Z-Tel Mpower's Loop to the Inside Wiring of a Customer Customer’s premises through the purchase and use of a Verizon BA’s NID in the manner set forth in this Section 911.3 and at the charges set forth in Exhibit A. Mpower must establish the connection to BA’s NID through an adjoining network interface device deployed by Mpower. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s premises and Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 11.3.2 In no case shall Z-Tel Mpower access, remove, disconnect or in any other way rearrange, Verizonrearrange BA’s Loop loop facilities [the Network side of the interface] from VerizonBA’s NIDs, enclosures, or protectors. 9.3 11.3.3 In no case shall Z-Tel Mpower access, remove, disconnect or in any other way rearrange, rearrange a Customercustomer’s Inside Wire from VerizonBA’s NIDs, enclosures, or protectors where such Customer customer Inside Wire is used in the provision of ongoing Telecommunications Telecommunication Service to that Customer. 9.4 11.3.4 In no case shall Z-Tel Mpower remove or disconnect ground wires from VerizonBA’s NIDs, enclosures, or protectors. 9.5 11.3.5 In no case shall Z-Tel Mpower remove or disconnect NID modules, protectors, or terminals from VerizonBA’s NID enclosures. 9.6 11.3.6 Maintenance and control of premises wiring (Inside Wiring Wire) is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). . 11.3.7 When Z-Tel Mpower is not connecting a Z-Tel-Mpower provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon BA NID, Z-Tel Mpower does not need to submit a request to Verizon BA and Verizon BA shall not charge Z-Tel Mpower for access to the Verizon BA NID. In such instances, Z-Tel Mpower shall comply with the provisions of Sections 9.2 sections 11.3.2 through 9.7 of this Agreement 11.3.6 and shall access the Customer’s Inside Wire in the a manner set forth in Section 7 of this Agreement11.3.7.1 below. 9.7 11.3.7.1 Due to the wide variety of NIDs utilized by Verizon BA (based on Customer size and environmental considerations), Z-Tel Mpower may access the Customer’s Inside Wire, acting as the agent of the Customer end user by any of the following means: 9.7.1 (a) Where an adequate length of Inside Wire is present and environmental conditions permit, requesting carrier (i.e., Mpower or Mpower’s agent, the building owner, or the Customer) may remove the Inside Wire from the Customer’s side of the BA NID and connect that wire to Mpower’s NID; (b) Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel Mpower may enter the Customer side of the Verizon BA NID enclosure for the purpose of removing the Inside Wire from the terminals of VerizonBA’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon BA NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon BA NID. 9.7.2 Z-Tel may request Verizon (c) Request BA to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelMpower, its agent, the building owner or the Customer). , as set forth in Exhibit A. Verizon ALLTEL shall provide Z-Tel SOUTHEAST with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel SOUTHEAST may access a Verizon ALLTEL NID either by means of a Cross Connection connection (but only if the use of such Cross Connection connection is technically feasible) from an adjoining Z-Tel SOUTHEAST NID deployed by Z-Tel SOUTHEAST or, if an entrance module is available in the Verizon ALLTEL NID, by connecting a Z-Tel SOUTHEAST Loop to the Verizon ALLTEL NID. In all cases, Verizon ALLTEL shall perform this Cross Connectionconnection. When necessary, Verizon ALLTEL will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 92.2 In no case shall Z-Tel SOUTHEAST access, remove, disconnect or in any other way rearrange, VerizonALLTEL’s Loop facilities from VerizonALLTEL’s NIDs, enclosures, or protectors. 9.3 92.3 In no case shall Z-Tel SOUTHEAST access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire Wiring from VerizonALLTEL’s NIDs, enclosures, or protectors where such Customer Inside Wire Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 92.4 In no case shall Z-Tel SOUTHEAST remove or disconnect ground wires from VerizonALLTEL’s NIDs, enclosures, or protectors. 9.5 92.5 In no case shall Z-Tel SOUTHEAST remove or disconnect NID modules, protectors, or terminals from VerizonALLTEL’s NID enclosures. 9.6 92.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire Wiring must be resolved by the person who controls use of the wire wiring (e.g., the Customer). . 92.7 When Z-Tel SOUTHEAST is connecting a Z-TelSOUTHEAST-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon ALLTEL NID, Z-Tel SOUTHEAST does not need to submit a request to Verizon ALLTEL and Verizon ALLTEL shall not charge Z-Tel SOUTHEAST for access to the Verizon ALLTEL NID. In such instances, Z-Tel SOUTHEAST shall comply with the provisions of Sections 9.2 92.2 through 9.7 92.7 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 92.8 of this Agreement. 9.7 92.8 Due to the wide variety of NIDs utilized by Verizon ALLTEL (based on Customer size and environmental considerations), Z-Tel SOUTHEAST may access the Customer’s Inside WireWiring, acting as the agent of the Customer by any of the following means: 9.7.1 92.8.1 Where an adequate length of Inside Wire Wiring is present and environmental conditions permit, SOUTHEAST may remove the Inside Wiring from the Customer’s side of the ALLTEL NID and connect that Inside Wiring to SOUTHEAST’s NID. 92.8.2 Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Z-Tel SOUTHEAST may enter the Customer side of the Verizon ALLTEL NID enclosure for the purpose of removing the Inside Wire Wiring from the terminals of VerizonALLTEL’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire Wiring within the space of the Customer side of the Verizon ALLTEL NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon ALLTEL NID. 9.7.2 Z-Tel . 92.8.3 SOUTHEAST may request Verizon ALLTEL to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelSOUTHEAST, its agent, the building owner or the Customer). If Z-Tel SOUTHEAST accesses the Customer’s Inside Wire Wiring as described in this Section 9.7.292.8.3, time and materials charges will be billed to the requesting party (i.e. Z-TelSOUTHEAST, its agent, the building owner or the Customer).

Verizon shall provide Z-Tel with access 11.3, or at any other technically feasible point, if any, as required by Applicable Law and, in such case, pursuant to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel Section 11.8 and Exhibit B. AT&T may access a Verizon NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel AT&T NID deployed by Z-Tel AT&T or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel an AT&T Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. Verizon shall not be responsible for resolving any conflicts between AT&T and third party service providers for access to the Customer’s premises and Inside Wire. 9.2 11.3.2 In no case shall Z-Tel AT&T access, remove, disconnect or in any other way rearrange, rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 11.3.3 In no case shall Z-Tel AT&T access, remove, disconnect or in any other way rearrange, rearrange a Customer’s Inside Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire is continues to be used in the provision of ongoing Telecommunications Service by Verizon to that Customer. 9.4 11.3.4 In no case shall Z-Tel AT&T remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 11.3.5 In no case shall Z-Tel AT&T remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 11.3.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). . 11.3.7 When Z-Tel AT&T is connecting a Z-Telan AT&T-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel AT&T does not need to submit a request to Verizon and Verizon shall not charge Z-Tel AT&T for access to the Verizon NID. In such instances, Z-Tel AT&T shall comply with the provisions of Sections 9.2 11.3.2 through 9.7 11.3.6 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 11.3.7.1 of this Agreement. 9.7 11.3.7.1 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel AT&T may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means: 9.7.1 (a) Where an adequate length of Inside Wire is present and environmental conditions permit, requesting carrier (i.e., AT&T or AT&T’s agent, the building owner, or the Customer) may remove the Inside Wire from the Customer’s side of the Verizon NID and connect that wire to AT&T’s NID; (b) Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel AT&T may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel (c) AT&T may request Verizon to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelAT&T, its agent, the building owner or the Customer). If Z-Tel AT&T accesses the Customer’s Inside Wire as described in this Section 9.7.211.3.7.1(c), time and materials charges will be billed to the requesting party (i.e. Z-TelAT&T, its agent, the building owner or the Customer).

Network Interface Device. 9.1 Subject to the conditions set forth in Section 1 and at Z-TelReconex’s request, Verizon shall permit Z-Tel Reconex to connect a Z-Tel Reconex Loop to the Inside Wiring of a Customer through the use of a Verizon NID in the manner set forth in this Section 9. Verizon shall provide Z-Tel Reconex with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel Reconex may access a Verizon NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel Reconex NID deployed by Z-Tel Reconex or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel Reconex Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Z-Tel Reconex access, remove, disconnect or in any other way rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Z-Tel Reconex access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Z-Tel Reconex remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Z-Tel Reconex remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). When Z-Tel Reconex is connecting a Z-TelReconex-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel Reconex does not need to submit a request to Verizon and Verizon shall not charge Z-Tel Reconex for access to the Verizon NID. In such instances, Z-Tel Reconex shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 of this Agreement. 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel Reconex may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means: 9.7.1 Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel Reconex may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel Reconex may request Verizon to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelReconex, its agent, the building owner or the Customer). If Z-Tel Reconex accesses the Customer’s Inside Wire as described in this Section 9.7.2, time and materials charges will be billed to the requesting party (i.e. Z-TelReconex, its agent, the building owner or the Customer).

Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel 9.8.3 NUI may request Verizon to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelNUI, its agent, the building owner or the Customer). Verizon Frontier shall provide Z-Tel Onvoy with access to NIDs in accordance with, but only to the extent required by, Applicable Lawthe Federal Unbundling Rules. Z-Tel Onvoy may access a Verizon Frontier NID either by means of a Cross Connection connection (but only if the use of such Cross Connection connection is technically feasible) from an adjoining Z-Tel Onvoy NID deployed by Z-Tel Onvoy or, if an entrance module is available in the Verizon Frontier NID, by connecting a Z-Tel an Onvoy Loop to the Verizon Frontier NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon Frontier will rearrange its facilities to provide access to an existing Customer’s Inside Wire. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon Frontier NID. 9.7.2 Z-Tel 9.8.3 Onvoy may request Verizon Frontier to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelOnvoy, its agent, the building owner or the Customer). In no case shall Z-Tel either Party remove or disconnect ground wires from Verizon’s the other Party's NIDs, enclosures, or protectors. 9.5 . In no case shall Z-Tel either Party remove or disconnect NID modules, protectors, or terminals from Verizon’s the other Party's NID enclosures. 9.6 . Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s 's Inside Wire Wiring must be resolved by the person who controls use of the wire wiring (e.g., the Customer). When ZPac-Tel West is connecting a ZPac-TelWest-provided Loop to the Inside Wiring of a Customer’s 's premises through the Customer’s 's side of the Verizon NID, ZPac-Tel West does not need to submit a request to Verizon and Verizon shall not charge ZPac-Tel West for access to the Verizon NID. In such instances, ZPac-Tel West shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement and shall access the Customer’s 's Inside Wire in the manner set forth in Section 7 9.8 of this Agreement. 9.7 . Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), ZPac-Tel West may access the Customer’s 's Inside WireWiring, acting as the agent of the Customer by any of the following means: 9.7.1 : Where an adequate length of Inside Wire Wiring is present and environmental conditions permit, Pac-West may remove the Inside Wiring from the Customer's side of the Verizon NID and connect that Inside Wiring to Pac-West's NID. Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, ZPac-Tel West may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire Wiring from the terminals of Verizon’s 's NID and connecting a connectorized or spliced jumper wire from a suitable “"punch out” " hole of such NID enclosure to the Inside Wire Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z. Pac-Tel West may request Verizon to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. ZPac-TelWest, its agent, the building owner or the Customer). If ZPac-Tel West accesses the Customer’s 's Inside Wire Wiring as described in this Section 9.7.29.8.3, time and materials charges will be billed to the requesting party (i.e. ZPac-TelWest, its agent, the building owner or the Customer).

Network Interface Device. 9.1 11.3.1 Subject to the conditions set forth in Section 1 11.7, and at Z-Tel’s requestthe request of TGI, Verizon BA shall permit Z-Tel TGI to connect a Z-Tel TGI's Loop to the Inside Wiring of a Customer Customer’s premises through the purchase and use of a Verizon BA’s NID in the manner set forth in this Section 911.3 and at the charges set forth in Exhibit A. TGI must establish the connection to BA’s NID through an adjoining network interface device deployed by TGI. Verizon The Customer shall provide Z-Tel with be responsible for resolving any conflicts between service providers for access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel may access a Verizon NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel NID deployed by Z-Tel or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s premises and Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 11.3.2 In no case shall Z-Tel TGI access, remove, disconnect or in any other way rearrange, Verizonrearrange BA’s Loop loop facilities [the Network side of the interface] from VerizonBA’s NIDs, enclosures, or protectors. 9.3 11.3.3 In no case shall Z-Tel TGI access, remove, disconnect or in any other way rearrange, rearrange a Customer’s Inside Wire from VerizonBA’s NIDs, enclosures, or protectors where such Customer Inside Wire is used in the provision of ongoing Telecommunications Telecommunication Service to that Customer. 9.4 11.3.4 In no case shall Z-Tel TGI remove or disconnect ground wires from VerizonBA’s NIDs, enclosures, or protectors.protectors.‌ 9.5 11.3.5 In no case shall Z-Tel TGI remove or disconnect NID modules, protectors, or terminals from VerizonBA’s NID enclosures. 9.6 11.3.6 Maintenance and control of premises wiring (Inside Wiring Wire) is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). . 11.3.7 When Z-Tel TGI is not connecting a Z-Tel-TGI provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon BA NID, Z-Tel TGI does not need to submit a request to Verizon BA and Verizon BA shall not charge Z-Tel TGI for access to the Verizon BA NID. In such instances, Z-Tel TGI shall comply with the provisions of Sections 9.2 sections 11.3.2 through 9.7 of this Agreement 11.3.6 and shall access the Customer’s Inside Wire in the a manner set forth in Section 7 of this Agreement11.3.7.1 below. 9.7 11.3.7.1 Due to the wide variety of NIDs utilized by Verizon BA (based on Customer size and environmental considerations), Z-Tel TGI may access the Customer’s Inside Wire, acting as the agent of the Customer end user, by any of the following means: 9.7.1 (a) Where an adequate length of Inside Wire is present and environmental conditions permit, requesting carrier (i.e., TGI or TGI's agent, the building owner, or the Customer) may remove the Inside Wire from the Customer’s side of the BA NID and connect that wire to TGI’s NID; (b) Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel TGI may enter the Customer side of the Verizon BA NID enclosure for the purpose of removing the Inside Wire from the terminals of VerizonBA’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon BA NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon BA NID. 9.7.2 Z-Tel may request Verizon (c) Request BA to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelTGI, its agent, the building owner or the Customer). , as set forth in Exhibit A. If Z-Tel TGI accesses the Customer’s Inside Wire as described in this Section 9.7.2paragraph (c), time and materials charges will be billed to the requesting party (i.e. Z-TelTGI, its agent, the building owner or the Customer).

Verizon shall provide Z-Tel LightWave with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel LightWave may access a Verizon NID either by means of a Cross Connection connection (but only if the use of such Cross Connection connection is technically feasible) from an adjoining Z-Tel LightWave NID deployed by Z-Tel LightWave or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel LightWave Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connectionconnection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to itit.‌‌‌‌‌‌‌‌‌ 9.2 2.2.1. In no case shall Z-Tel LightWave access, remove, disconnect or in any other way rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 2.2.2. In no case shall Z-Tel LightWave access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 2.2.3. In no case shall Z-Tel LightWave remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 2.2.4. In no case shall Z-Tel LightWave remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 2.2.5. Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire Wiring must be resolved by the person who controls use of the wire wiring (e.g., the Customer). 2.2.6. When Z-Tel LightWave is connecting a Z-TelLightWave-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel LightWave does not need to submit a request to Verizon and Verizon shall not charge Z-Tel LightWave for access to the Verizon NID. In such instances, Z-Tel LightWave shall comply with the provisions of Sections 9.2 2.2.1 through 9.7 2.2.6 of this Agreement UNE Remand Attachment and shall access the Customer’s Inside Wire in the manner set forth in Section 7 2.2.7 of this AgreementUNE Remand Attachment. 9.7 2.2.7. Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel LightWave may access the Customer’s Inside WireWiring, acting as the agent of the Customer by any of the following means: 9.7.1 2.2.8. Where an adequate length of Inside Wire Wiring is present and environmental conditions permit, LightWave may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to LightWave’s NID. 2.2.9. Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Z-Tel LightWave may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID.NID.‌‌‌‌‌ 9.7.2 Z-Tel 2.2.10. LightWave may request Verizon to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelLightWave, its agent, the building owner or the Customer). If Z-Tel LightWave accesses the Customer’s Inside Wire Wiring as described in this Section 9.7.22.2.10, time and materials charges will be billed to the requesting party (i.e. Z-TelLightWave, its agent, the building owner or the Customer).

Z-Tel AURA may access a Verizon NID either by means of a Cross Connection (but only if the use of such Cross Connection is technically feasible) from an adjoining Z-Tel AURA NID deployed by Z-Tel AURA or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel AURA Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. In such instances, Z-Tel AURA shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 6 of this Agreement. 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel AURA may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means: 9.7.1 Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel AURA may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel AURA may request Verizon to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelAURA, its agent, the building owner or the Customer). If Z-Tel AURA accesses the Customer’s Inside Wire as described in this Section 9.7.2, time and materials charges will be billed to the requesting party (i.e. Z-TelAURA, its agent, the building owner or the Customer).

Any conflicts between service providers for access to the Customer’s Inside Wire must be resolved by the person who controls use of the wire (e.g., the Customer). . 9.7 When Z-Tel Tech Com is connecting a Z-TelTech Com-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel Tech Com does not need to submit a request to Verizon and Verizon shall not charge Z-Tel Tech Com for access to the Verizon NID. In such instances, Z-Tel Tech Com shall comply with the provisions of Sections 9.2 through 9.7 9.8 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 6 of this Agreement. 9.7 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel Tech Com may access the Customer’s Inside Wire, acting as the agent of the Customer by any of the following means: 9.7.1 9.8.1 Where an adequate length of Inside Wire is not present or environmental conditions do not permit, Z-Tel Tech Com may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel 9.8.2 Tech Com may request Verizon to make other rearrangements to the Inside Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelTech Com, its agent, the building owner or the Customer). If Z-Tel Tech Com accesses the Customer’s Inside Wire as described in this Section 9.7.29.8.2, time and materials charges will be billed to the requesting party (i.e. Z-TelTech Com, its agent, the building owner or the Customer).

Verizon shall provide Z-Tel Cinergy with access to NIDs in accordance with, but only to the extent required by, Applicable Law. Z-Tel Cinergy may access a Verizon NID either by means of a Cross Connection connection (but only if the use of such Cross Connection connection is technically feasible) from an adjoining Z-Tel Cinergy NID deployed by Z-Tel Cinergy or, if an entrance module is available in the Verizon NID, by connecting a Z-Tel Cinergy Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connectionconnection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. In no case shall Z-Tel Cinergy access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wire Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wire Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 4. In no case shall Z-Tel Cinergy remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 5. In no case shall Z-Tel Cinergy remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 6. Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wire Wiring must be resolved by the person who controls use of the wire wiring (e.g., the Customer). 7. When Z-Tel Cinergy is connecting a Z-TelCinergy-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Z-Tel Cinergy does not need to submit a request to Verizon and Verizon shall not charge Z-Tel Cinergy for access to the Verizon NID. In such instances, Z-Tel Cinergy shall comply with the provisions of Sections 9.2 through 9.7 of this Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 7 9.8 of this Agreement. 9.7 8. Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Z-Tel Cinergy may access the Customer’s Inside WireWiring, acting as the agent of the Customer by any of the following means: 9.7.1 1. Where an adequate length of Inside Wire Wiring is present and environmental conditions permit, Cinergy may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Cinergy’s NID. 2. Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Z-Tel Cinergy may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wire Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “"punch out” " hole of such NID enclosure to the Inside Wire Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.7.2 Z-Tel 3. Cinergy may request Verizon to make other rearrangements to the Inside Wire Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Z-TelCinergy, its agent, the building owner or the Customer). If Z-Tel Cinergy accesses the Customer’s Inside Wire Wiring as described in this Section 9.7.29.8.3, time and materials charges will be billed to the requesting party (i.e. Z-TelCinergy, its agent, the building owner or the Customer).
