NFC Representation. (i) Party B represents to Party A as at the date of this Agreement and on each date on which a Transaction is entered that it is an NFC-. (ii) Party B will notify Party A if at any time it ceases to be an NFC-. (iii) Notwithstanding anything to the contrary in this Agreement, if the representation set out in Part 5(x)(i) above proves to have been incorrect or misleading in any material respect when made (or deemed repeated) by Party B, neither a Termination Event nor an Event of Default will occur in respect of this Agreement.
