Common use of No Acceptance of Premises Clause in Contracts

No Acceptance of Premises. So long as Tenant engages only in the activities enumerated in Section 7.1, the fact that Tenant, with Landlord's consent, may enter the Premises prior to the date Landlord's Work is Substantially Complete shall not be deemed an acceptance by Tenant of possession of the Premises, but in such event Tenant shall indemnify and hold Landlord harmless from any loss of or damage to Tenant property, completed work, fixtures, equipment, materials or merchandise, and from liability for death of, or injury to, any person, caused by the willful misconduct or negligence of Tenant or its agents.
