Common use of NO AGREEMENT TO JURISDICTION Clause in Contracts

NO AGREEMENT TO JURISDICTION. By entering into this Agreement, which shall be filed with the Commission and notwithstanding any provision in this Agreement, the Operating ZoneInterchange Equipment Operators are not in any way agreeing individually or collectively that their activities under this Agreement are subject to Commission jurisdiction. In addition, nothing in this Agreement shall be construed (a) to confer Commission jurisdiction over Operating ZoneInterchange Equipment Operators that are not public utilities as defined by the Federal Power Act, or (b) as a consent or waiver with respect to such jurisdiction, or (c) to cause a non-public utility to take any action or participate in any filing or appeal that would confer Commission jurisdiction over a non-public utility or require a non-public utility to comply with any Order or Rule issued by the Commission. A Party’s actions, decisions, and performance under this Agreement, including without limitation the exercise of its rights to withdraw from or terminate this Agreement, shall not be subject to Commission approval.
