Common use of No Bar Clause in Contracts

No Bar. If the Hold Back Shares are insufficient to set off any claim for any Indemnifiable Damages hereunder (or have been delivered in whole or in part to the Sellers prior to the making or resolution of such claim), then Purchaser may take any action or exercise any remedy available to it by appropriate legal proceeding to collect the Indemnifiable Damages.

If the Hold Held Back Shares are insufficient to set off any claim for any Indemnifiable Damages hereunder or for Aggregate Indemnifiable Damages (or have been delivered in whole or in part to the Sellers Seller prior to the making or resolution of such claim), then the Purchaser may take any action or exercise any remedy available to it by appropriate legal proceeding proceedings to collect the Indemnifiable Damages or Aggregate Indemnifiable Damages.
