Common use of No Change in Condition Clause in Contracts

No Change in Condition. On the Closing Date, the Property (including, without limitation, any Utilities) shall be in a state of repair at least as good as the state of repair as of the expiration of the Due Diligence Period, normal wear and tear alone excepted, and there shall be no material change in the physical or environmental condition of the Property as of the expiration of the Due Diligence Period.
