Common use of NO CHANGE TO TERMS Clause in Contracts

NO CHANGE TO TERMS. All terms of the Securities Purchase Agreement, Notes, Warrants, the Security Documents and other Transaction Documents, as amended prior to the date hereof, are, and shall continue to be, in full force and effect and are hereby ratified and confirmed in all respects. Except as explicitly set forth herein, the Holder reserves all of its rights, remedies, powers, and privileges. For the avoidance of doubt, nothing herein shall be deemed to entitle the Company to a consent to, or a waiver, amendment, modification or other change of, any of the terms, conditions, obligations, covenants or agreements contained in the Notes or any other Transaction Documents, including without limitation, to an amendment of the terms of any future Company Optional Redemption or to a consent to any future Control Account Company Release Event, either in similar or different circumstances.
