Common use of No Consequential Loss Clause in Contracts

No Consequential Loss. Notwithstanding anything in this Agreement to the contrary, the Company shall not be liable to the Supplier for any indirect loss or damage of any nature whatsoever whether based on contract, warranty, tort (including negligence) or otherwise including loss of production or business interruption, loss of revenue or loss of profits howsoever arising and the parties agree that such loss or damages will not be claimed as direct loss or damage. The Company’s aggregate liability to the Supplier under this Agreement shall be limited to the amount outstanding under any invoice owing under clause 6.
