No Conveyance of Ownership; Trade Secrets. This Agreement does not convey to Licensee ownership of the Software or Documentation or any media delivered to Licensee on which the Software is stored, but only the right to use the Software, Documentation and media as provided in this Agreement. Licensee acknowledges that the Software (including without limitation its structure, organization and code), the Documentation and Primus' and Xxxxxx XX'ss Confidential Information, and all technical data and information associated therewith constitute trade secrets and are the valuable property of Primus, Xxxxxx XX and their licensors and that the Software and Documentation are protected by copyright and trademark rights.
