Common use of No Diversion of Assets and Nonforfeitability Clause in Contracts

No Diversion of Assets and Nonforfeitability. At no time shall it be possible for any part of the assets of a Participant Account to be used for or diverted to purpose other than for the exclusive benefit of the Participant and the Participant’s Beneficiary, as applicable, or for the payment of expenses and other amounts as specifically provided in this Custodial Agreement. The interest of a Participant in the Participant Account shall be nonforfeitable at all times except as may otherwise be provided under the Plan and applicable law.
