No Duty to Diversify. For the avoidance of doubt, under no circumstances shall the Trustee have a duty to sell any shares of Company Stock in order to diversify the investments of the Trust Fund.

No Duty to Diversify. The Trustee shall have no duty to diversify Trust assets. The Trustee’s sole duty is to manage and distribute Trust Assets in accordance with the Rehabilitation Agreement, this Trust Agreement and the Insurance Code.

Lender shall not be required to mitigate damages or take any other action pertaining to any Other Borrower or any Other Borrower Collateral to reduce, collect or enforce the Debt from any Other Borrower.

  • Limitation on Duty to Collect Custodian shall not be required to enforce collection, by legal means or otherwise, of any money or property due and payable with respect to Securities held for the Fund if such Securities are in default or payment is not made after due demand or presentation.

  • No Right to Distributions in Kind No Partner shall be entitled to demand property other than cash in connection with any distributions by the Partnership.
