No Duty to Investigate. No Agent shall at any time, unless requested to do so by a Lender or Lenders, be under any duty to enquire whether an Event of Default, or an event which with the giving of notice or lapse of time, or both, would constitute an Event of Default, has occurred or to investigate the performance of this Agreement, the Note or any Security Document by any Security Party; and
No Duty to Investigate. Neither [the Securities Insurer,] the Master Servicer, the Owner Trustee nor the Indenture Trustee shall have any duty to conduct any affirmative investigation other than as specifically set forth in this Agreement as to the occurrence of any condition requiring the repurchase or substitution of any Home Loan pursuant to this Section or the eligibility of any Home Loan for purposes of this Agreement.
No Duty to Investigate. Licensees acting as a Transaction Broker have no duty to:
(a) Conduct an independent inspection of the Property for the benefit of either SELLER/LANDLORD or BUYER/TENANT,
(b) To independently verify the accuracy or completeness of statements made by the SELLER/LANDLORD, BUYER/TENANT or qualified third party inspectors,
(c) To conduct an independent investigation of the BUYER’S/TENANT’S financial condition, or
(d) To verify the accuracy or completeness of any statement made by the SELLER or BUYER.
No Duty to Investigate. The Voting Trustees shall not be bound to make any investigation into the facts or matters stated in any resolution, certificate, statement, instrument, opinion, report, notice, request, direction, consent, order or other paper or document submitted to the Voting Trustees.
No Duty to Investigate. None of the Servicer, the Issuer, the Owner Trustee, the Indenture Trustee, the Sponsor, the Depositor or the Administrator will have an obligation to investigate whether a breach or other event has occurred that would require the purchase of any Receivable under this Section 3.3 or whether any Receivables is required to be purchased under this Section 3.3.
No Duty to Investigate. The Trustee has no duty, and is under no obligation, to investigate whether a Servicer Default or a Perfection of Title Event has occurred other than where it has actual notice that such event has occurred.
No Duty to Investigate neither Facility Agent nor the Security Trustee, as the case may be, shall at any time, unless requested to do so by a Lender or Lenders, be under any duty to investigate whether an Event of Default or a Default has occurred or to investigate the performance of the Borrower under or pursuant to this Agreement and the other Loan Documents;
No Duty to Investigate. Unless there is an apparent deficiency in relation to a transaction, no individual or person dealing with the Trustee or any officer, employee or agent of the Trustee or CGIF shall be bound to make any inquiry concerning the validity of any transaction purported to be made by the Trustee or by said officer, employee or agent or be liable for the application of money or property paid, loaned to or delivered to or on the order of the Trustee or of said officer, employee or agent. Every obligation, contract, agreement, certificate or undertaking, and every other act or thing whatsoever executed in connection with CGIF, shall be conclusively presumed to have been executed or done by the executors thereof only in their capacity as officers, employees or agents of the Trustee or CGIF.
No Duty to Investigate. The Investment Corporation may rely on the representations contained and referenced in this Agreement without further duty of inquiry as to their accuracy and validity.
No Duty to Investigate. The Trustee will bear no liability for acting upon any instruction or document believed by it to be genuine and to be presented or signed by a party duly authorized to do so, and the Trustee will be under no duty to make any investigation or inquiry about the correctness of such instruction or document.
