NO EXCLUSIVE TERRITORY. DISTRIBUTOR ACKNOWLEDGES THAT THIS AGREEMENT DOES NOT PROVIDE DISTRIBUTOR WITH ANY RIGHT OR INTEREST IN ANY EXCLUSIVE TERRITORY, AND THAT VMSC MAY, IN ITS SOLE AND ABSOLUTE DISCRETION OPERATE, OR AUTHORIZE OTHER JOBBERS, FRANCHISEES, OR LICENSEES OF VMSC TO OPERATE, RETAIL FUEL DISPENSING FACILITIES AT ANY AVAILABLE LOCATIONS, INCLUDING LOCATIONS IN DIRECT COMPETITION WITH DISTRIBUTOR, WHICH ARE APPROVED BY VMSC IN VMSC’S SOLE AND ABSOLUTE DISCRETION.

NO EXCLUSIVE TERRITORY. BRCB does not grant Franchisee an exclusive territory. BRCB and its affiliates and other franchisees may own and operate Coffee Bars or otherwise market and sell products and services using the Proprietary Marks in the immediate vicinity of the Premises. BRCB retains the right, for BRCB and its affiliates and other franchisees, to: (a) own, acquire, establish and/or operate, and license others to establish and operate, businesses using the Proprietary Marks and BRCB System at any location, (b) own, acquire, establish and/or operate, and license others to establish and operate, businesses under other proprietary marks or other systems, at any location; (c) to sell or distribute, at retail or wholesale or otherwise, directly or indirectly, or license others to sell or distribute, any products which bear any proprietary marks, including the Proprietary Marks, at any location; (d) to acquire, or be acquired by, any competing system, including a competing system that has one or more units in the immediate vicinity of the Premises; and (e) to market and sell coffee and espresso beans, equipment, clothing, and other items at any location through other distribution methods, such as via the Internet or catalogs.
NO EXCLUSIVE TERRITORY. NOTHING CONTAINED HEREIN SHALL BE DEEMED, EXPRESSLY OR BY IMPLICATTON, TO GRANT FRANCHISEE ANY TYPE OF EXCLUSIVE OR PROTECTED TERRITORY. FRANCHISOR MAY OWN, OPERATE, FRANCHISE OR LICENSE OR IN ANY OTHER MANNER AUTHORIZE THE LOCATION AND OPERATION OF OTHER REAL ESTATE BROKERAGE BUSINESSES AT ANY LOCATION WHATSOEVER AND NOTHING CONTAINED HEREIN SHALL BE DEEMED, EXPRESSLY OR BY IMPLICATION, TO LIMIT, CONTROL, OR PREVENT SUCH RIGHT. Franchisee acknowledges that in the exercise of the rights expressly reserved to Franchisor under this Franchise Agreement, it is like1y that Franchisor will open, or authorize others to open, additional real estate brokerage office locations with respect to which Franchisee has no right or interest; that such market development is an integral part of the marketing concept underlying Franchisor’s business and the development of the Network.

ANY ORAL REPRESENTATIONS TO THE CONTRARY BY ANY STEREN REPRESENTATIVE OR EMPLOYEE ARE NULL AND VOID.
NO EXCLUSIVE TERRITORY. 2.1. By this Appointment, Dealer has no exclusive territory (geographical, internet presence, area of influence, customers, or otherwise). IPI makes no disclosure or representation to Dealer as regards the proximity of Dealer’s location or areas of operation in proximity to any other Dealer or vendor of IPI products, however described. Further, IPI may freely establish hereafter other Dealers or vendors, however described, for IPI products, in any tangible or intangible proximity to Dealer.
NO EXCLUSIVE TERRITORY. Top Level Dealer does not have the authority or right to assign to Second Level Dealer any exclusive geographical area, or territory, within which Second Level Dealer is to resell the Products. If GHS has assigned to Top Level Dealer a territory in which Top Level Dealer is expected to focus its efforts to sell and promote the sale of GHS Products, then Second Level Dealer shall be expected to focus its efforts to sell and promote the sale of GHS Products in that same territory.

NO EXCLUSIVE TERRITORY. Representative, directly and/or through its subrepresentatives, will be entitled to solicit and procure memberships within any state in the United States that appears on ASSI’s approved list of states, subject to compliance with the other terms and conditions of this Agreement. Representative shall be responsible for keeping apprised of, and keeping its subrepresentatives apprised of, the then current list of ASSI’s approved states, it being understood by Representative that states may be added or deleted from time to time, in ASSI’s sole and absolute discretion. Representative shall have no primary or exclusive territory and Representative understands and acknowledges that ASSI can be expected to appoint others to solicit and procure memberships within ASSI’s approved lists of states and thus Representative and its subrepresentatives will be competing for business with one or more other ASSI representatives and/or subrepresentatives.
NO EXCLUSIVE TERRITORY. There is no exclusive territory to persuade people to join in the business group, or there is no distributor that can imply or say that he/she has an exclusive right in any territories. There is no geographical limitation for sponsoring the Distributor of Hylife.
NO EXCLUSIVE TERRITORY. 2.3.1 The license and franchise granted to the Operator under this Agreement is non-exclusive, and does not grant Operator any protected trading area or territory, nor any rights to obtain additional franchises from Franchisor. Without limiting the generality of the foregoing, the Franchisor expressly reserves the exclusive, unrestricted right, in its sole and absolute discretion, directly and indirectly: (a) to own or operate, and to franchise and license others to own, operate or co-brand, coffeehouses, kiosks, and carts at any location other than at the specific Location identified in Section 5.1.1, regardless of its proximity to the Coffeehouse operated pursuant hereto; and (b) to produce, promote, license, distribute and market products, whether or not they bear any of the Marks, at wholesale or retail, through its employees, affiliates, representatives, licensees, franchisees, assigns, agents and others, including bulk and pre-packaged roasted coffee, premium teas, ice cream, beverages, snacks and other food products; clothing; books, souvenirs and novelty items, through any outlet or channel of commerce, including grocery stores and convenience stores (regardless of their proximity to Operator's Coffeehouse), sales by means of the internet, mail order catalogs, direct mail advertising, vending machines and other distribution methods.
