Common use of No Express Warranty Clause in Contracts

No Express Warranty. Other than as set forth herein, University makes no warranties, express or implied, as to any matter whatsoever, including, without limitation, warranties with respect to the conduct, success or particular results of the Project Proposal, or the condition, ownership, merchantability, or fitness for a particular purpose of the results of the Project Proposal or any University intellectual property. University shall not be liable for any indirect, consequential, punitive or non-actual damages arising within the scope of this Agreement or the use of any University intellectual property product.
