Common use of No Further Modification or Amendment Clause in Contracts

No Further Modification or Amendment. Except as provided in this First Amendment, the Original Agreement and all of its terms and conditions shall continue in full force and effect. This First Amendment and the Original Agreement shall be construed as a whole in order to effectuate the intent of Declarant Owner in entering into this First Amendment. Subject to the foregoing, if any provisions of the Original Agreement conflicts with the terms of this First Amendment, then the provisions of this First Amendment shall control.
