Susanville has not caused any, and to Susanville’s Knowledge there has been no, release, spill or discharge of any Hazardous Material on, in or under the property owned or leased by Susanville during the period of Susanville’s use or occupancy of or access to the Susanville Power Facility site. Other than as set forth in that certain Phase I Environmental Site Assessment Report dated November 26, 2001 (the “Phase I November 2001 Report”), there are no Recognized Environmental Conditions (as defined in the Phase I November 2001 Report) with respect to the Facility.
