Common use of No Increased Obligations Clause in Contracts

No Increased Obligations. If: 31.6.1 a Bank assigns or transfers any of its rights or obligations under the Finance Documents or changes its Facility Office; and 31.6.2 as a result of circumstances existing at the date of the assignment, transfer or change of Facility Office, an Obligor would be obliged to make a payment to the assignee, Transferee or the Bank acting through its new Facility Office under Clause 11.1 (Tax Gross-up), Clause 11.2 (Tax Indemnity) or Clause 13 (Increased Costs), then the assignee, Transferee or the Bank acting through its new Facility Office shall only be entitled to receive payment under those Clauses to the same extent as the assignor, transferor or the Bank acting through its previous Facility Office would have been if the assignment, transfer or change had not occurred.

If: 31.6.1 30.7.1 a Bank assigns or transfers any of its rights or obligations under the Finance Documents or changes its Facility Office; and 31.6.2 30.7.2 as a result of circumstances existing at the date of the assignment, transfer or change of Facility Office, an Obligor would be obliged to make a payment to the assignee, Transferee or the Bank acting through its new Facility Office under Clause 11.1 10.1 (Tax Gross-up), Clause 11.2 10.2 (Tax Indemnity) or Clause 13 12 (Increased Costs), then the assignee, Transferee or the Bank acting through its new Facility Office shall only be entitled to receive payment under those Clauses to the same extent as the assignor, transferor or the Bank acting through its previous Facility Office would have been if the assignment, transfer or change had not occurred.
