No Legal Title to Trust Property in the Holders. Legal title to the Trust Property shall be held by the Trustees in the name of the Trust, and the Holders shall not have legal title to any part of the Trust Property. The Holders shall be entitled to receive Distributions with respect to their Royalty Share Payments only in accordance with Article V. Neither the bankruptcy, death or other incapacity of any Holder, nor the transfer, by operation of law or otherwise, of any right, title or interest of the Holders in and to the Trust Property or hereunder shall terminate this Trust Agreement. Except as expressly set forth herein, the Holders shall not be liable for any liabilities or obligations of the Trust, the Trustees, or for the performance of this Trust Agreement.
