No liability in relation to capacity. Aurizon Network will not have any liability to the Trustee or the Unit Holder in respect of any Claim arising out of, or in any way related to, the level of capacity created by the Extension except for any liability Aurizon Network may have under the Access Undertaking or an Access Agreement.
