No Limitation on Bargaining Rights. Except as expressly provided in the Applicable CBA, nothing in this Article III or elsewhere in this Agreement shall preclude SpinCo or, as applicable, any member of the SpinCo Group from bargaining in good faith, after the Assumption Date or the Effective Time, with the Union representing those Represented Employees.
