Common use of No Merger of Estates Clause in Contracts

No Merger of Estates. The leasing by the Corporation to the District of the Leased Property pursuant to this Lease-Purchase Agreement shall not effect or result in a merger of the District’s leasehold estate pursuant hereto and its fee estate. The Corporation shall continue to have and hold a leasehold estate in the Leased Property pursuant to the Site Lease throughout the term thereof and the term of this Lease-Purchase Agreement. As to the Leased Property, this Lease-Purchase Agreement shall be deemed and constitute a sublease.

The leasing by the Corporation to the District of the Leased Property Facilities pursuant to this Lease-Lease Purchase Agreement shall not effect or result in a merger of the District’s leasehold estate pursuant hereto and its fee estate. The Corporation shall continue to have and hold a leasehold estate in the Leased Property Facilities pursuant to the Site Lease throughout the term thereof and the term of this Lease-Lease Purchase Agreement. As to the Leased PropertyFacilities, this Lease-Lease Purchase Agreement shall be deemed and constitute a sublease.

The Corporation shall continue to have and hold a leasehold estate in the Leased Property pursuant to the Site Lease throughout the term thereof and the term of this Lease-/Purchase Agreement. As to the Leased Property, this Lease-/Purchase Agreement shall be deemed and constitute a sublease.
