No Other Diagnostics Clause Samples
The "No Other Diagnostics" clause restricts the parties to using only specified diagnostic tests or procedures, prohibiting the use of any additional or alternative diagnostics not expressly authorized in the agreement. In practice, this means that if a party wishes to conduct further testing or analysis beyond what is listed, they must seek explicit permission or an amendment to the contract. This clause serves to control costs, maintain consistency in testing methods, and prevent disputes over the validity or necessity of unapproved diagnostics.
No Other Diagnostics. For purposes of clarity, unless otherwise mutually agreed by the Parties, neither Party shall have any right, under the licenses granted to such Party pursuant to Section 8.1 and notwithstanding the definition of “Field” hereunder, to Develop, Manufacture or Commercialize any biomarker or diagnostic product for use with the Shared Products, other than a Companion Diagnostic pursuant to this Section 3.6.
