No Predecessor Liability. The Company specifically acknowledges and agrees that (a) Funds Distributor does not accept or assume any liabilities, and do not agree to pay, perform :;)r discharge any indemnification obligations, under the Agreement resulting from actions of ▇▇▇▇▇▇▇▇ prior to the date upon which the Agreement was assigned from ▇▇▇▇▇▇▇▇ to Funds Distributor, and (b) the Company shall seek indemnification from ▇▇▇▇▇▇▇▇, and not from Funds Distributor or any of its affiliates, for all claims, suits, actions, losses, damages, liabilities, costs, and expenses of any nature whatsoever resulting from actions of ▇▇▇▇▇▇▇▇ prior to the date upon which the Agreement is assigned from ▇▇▇▇▇▇▇▇ to Funds Distributor.
