Common use of No Public Law Duty Clause in Contracts

No Public Law Duty. Where the City is required or permitted by this Agreement to form an opinion, exercise a discretion, express satisfaction, make a determination or give its consent, the Owner agrees that the City is under no public law duty of fairness or natural justice in that regard and agrees that the City may do any of those things in the same manner as if it were a private party and not a public body.

Where the City Municipality is required or permitted by this Agreement to form an opinion, exercise a discretion, express satisfaction, make a determination or give its consent, the Owner agrees that the City Municipality is under no public law duty of fairness or natural justice in that regard and agrees that the City Municipality may do any of those things in the same manner as if it were a private party and not a public body.

Where Wherever this Agreement creates a power or obligation of the City is required or permitted by this Agreement to form an opinion, exercise a discretion, express satisfaction, make a determination decision or give its consentto exercise any contractual right or remedy, the Owner agrees that the City is under no public law duty of fairness or natural justice in that regard and agrees that the City may do so in accordance with the provisions of this Agreement and no public law duty, whether arising from the principles of procedural fairness or the rules of natural justice, shall have any of those things in the same manner as if it were a private party and not a public bodyapplication.
