Common use of No Ratification of Unlicensed Attachments or Unauthorized Use of SWBT’s Facilities Clause in Contracts

No Ratification of Unlicensed Attachments or Unauthorized Use of SWBT’s Facilities. No act or failure to act by SWBT with regard to any unlicensed attachment or occupancy or unauthorized use of SWBT’s facilities shall be deemed to constitute a ratification by SWBT of the unlicensed attachment or occupancy or unauthorized use, nor shall the payment by Applicant of fees and charges for unauthorized pole attachments or conduit occupancy exonerate Applicant from civil or criminal liability for any deliberate trespass or other illegal or wrongful conduct in connection with the placement or use of such unauthorized facilities.
