Common use of No Ratification or Waiver Clause in Contracts

No Ratification or Waiver. No act or failure to act by Ameritech with regard to said unauthorized use shall be deemed as a ratification or the permitting of the unauthorized use; and if any permit should be subsequently issued, said permit shall not operate retroactively or constitute a waiver by Ameritech of any of its rights or privileges under this Agreement or otherwise; provided, however, that CLEC shall be subject to all liabilities, obligations and responsibilities of this Agreement in regards to said unauthorized use from its inception.
