Common use of No rescission or nullification Clause in Contracts

No rescission or nullification. Each Party waives its right to rescind (ontbinden) this Agreement, in whole or in part, on the basis of article 6:265 BW. Furthermore, a Party in error (dwaling) shall bear the risk of that error in making this Agreement and waives its right to nullify (vernietigen) this Agreement or to request a competent court to amend this Agreement on the basis of article 6:230(2) BW.
