Common use of No resumption Clause in Contracts

No resumption. 33. Subject to the performance by the Company of its obligations under this Agreement, the State shall not during the currency of this Agreement, without the consent of the Company, resume or suffer or permit to be resumed by any State instrumentality or by any local or other authority of the State any of the works, installations, plant, equipment or other property for the time being belonging to the Company and the subject of or used for the purpose of this Agreement AND without the consent of the Company (which shall not be unreasonably withheld), the State shall not create or grant or permit or suffer to be created or granted by any instrumentality or authority of the State as aforesaid any road, right‑of‑way, water right or easement of any nature or kind whatsoever over or in respect of the power station site which may unduly prejudice or interfere with the Company’s activities under this Agreement.
