Common use of No resumption Clause in Contracts

No resumption. 22. Subject to the performance by the Partnership of its obligations under this Agreement the State shall not during the currency of this Agreement without the consent of the Partnership resume nor suffer nor permit to be resumed by any State instrumentality or by any local or other authority of the State any of the works installations plant equipment or other property for the time being belonging to the Partnership and the subject of or used for the purpose of this Agreement AND without the consent of the Partnership (which shall not be unreasonably withheld) the State shall not create or grant or permit or suffer to be created or granted by any instrumentality or authority of the State as aforesaid any road right‑of‑way water right or easement of any nature or kind whatsoever over or in respect of the power station site and ancillary works and facilities which may unduly prejudice or interfere with the Partnership’s activities under this Agreement.
