Common use of NO RIGHTS OR LIABILITIES AS STOCKHOLDERS Clause in Contracts

NO RIGHTS OR LIABILITIES AS STOCKHOLDERS. This Warrant shall not entitle the holder thereof to any of the rights of a stockholder of the Company, except as expressly contemplated herein. No provision of this Warrant, in the absence of the actual exercise of such Warrant and receipt by the holder thereof of Common Stock issuable upon such conversion, shall give rise to any liability on the part of such holder as a stockholder of the Company, whether such liability shall be asserted by the Company or by creditors of the Company.
