Common use of No Setoffs Clause in Contracts

No Setoffs. Borrower hereby declares that Xxxxxxxx has no setoffs, counterclaims, defenses or other causes of action against Lender arising out of the Loan or any documents mentioned herein; and to the extent any such setoffs, counterclaims, defenses or other causes of action may exist, whether known or unknown, such items are hereby waived by Borrower.
