The rights of Employee hereunder have been granted by XXX with the understanding that this Agreement is personal to, and shall be performed by Employee individually. This Agreement is not transferable or assignable by Employee in any manner. No person or entity other than XXX and Employee shall have any rights whatsoever under this Agreement. No person or entity other than XXX or Employee shall have any right to enforce any provision of this Agreement, or to recover damages on account of the breach of this Agreement.
