No Violation of Applicable Law. To the best of the Borrower's knowledge, neither the Borrower nor any of its Subsidiaries has violated any applicable statute, regulation or ordinance of the United States of America or any foreign country, or any state, municipality or other jurisdiction, or of any agency thereof in any respect materially and adversely affecting the business, property, assets, operations or condition, financial or otherwise, of Borrower and its Subsidiaries, taken as a whole, and the Borrower has not received any notice of probable violation from the Department of Energy or the Environmental Protection Agency. The Borrower is using the Borrower's best efforts to comply or cause its Subsidiaries to comply with all statutes, rules and regulations relating to environmental standards and controls in all jurisdictions where the Borrower and its Subsidiaries are presently doing business.
