Common use of NO WAIVER OF GOVERNMENTAL IMMUNITY ACT Clause in Contracts

NO WAIVER OF GOVERNMENTAL IMMUNITY ACT. The parties hereto understand and agree that the respective Counties and Cities, their commissioners, officials, officers, directors, agents, and employees, are relying on, and do not waive or intend to waive by any provisions of this Agreement, the monetary limitations or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act (the “CGIA”), § 00-00-000 to 120, C.R.S., or otherwise available). To the extent the CGIA imposes varying obligations or contains different waivers of immunity the parties agree that each will remain liable for its independent obligations under the CGIA, and neither party shall be the agent of the other or liable for the obligations of the other. No party shall be liable under this Agreement for the actions of the other’s employees and agents. By agreeing to this provision, the parties do not waive or intend to waive, the limitations on liability which are provided to parties under the Colorado Governmental Immunity Act, C.R.S §§00-00-000, et seq.
