No Warehousing. Advance will be made against any Mortgage Loan that Lender believes may be based on untrue, incomplete or inaccurate or fraudulent information or may otherwise be subject to fraud.
No Warehousing. Advance will be made against a Mortgage Loan with an original principal balance in excess of $2,000,000.
No Warehousing. Advance shall be made against a Mortgage Loan other than an Eligible Loan or a Nonperforming Mortgage Loan or an REO Property.
No Warehousing. GAR is not a Warehouse or Depositor for Hire as that term is used in Civil Code § 1813, et seq. Accordingly any raw materials, components and/or finished product left at GAR’s facility, without open orders, in excess of 90 days will be disposed of at the discretion of GAR and at Buyer’s expense. Buyer is responsible to pick up and transport Buyer’s raw materials, components and/or finished product remaining at GAR’s facility. Any such raw materials, components and/or finished product remaining after the 90 days will be assumed to be abandoned by Xxxxx. GAR is not obligated to, but will endeavor to give Buyer at least 15 days’ notice of GAR’s intention to remove any such abandoned raw materials, components and/or finished products. If after the 15 days the materials have not been physically removed by Buyer at Buyers expense, then GAR will dispose of such raw materials, components and/or finished product for which Buyer shall reimburse GAR for the cost to accomplish the same. Said cost may include, but is not necessarily limited to, transportation costs, storage costs, labor and hazardous waste disposal fees.
No Warehousing. Advance other than a Repurchase Advance shall be made against any Mortgage Loan which was closed more than ninety (90) days prior to the date of the requested Advance, except with the Lender's prior written consent.
No Warehousing. Advance (other than Warehousing Advances made on the Closing Date to refinance Existing Agreement Warehousing Advances) shall be made against any Mortgage Loan other than an FHA Construction Mortgage Loan which was closed more than thirty (30) days prior to the date of the requested Advance.
No Warehousing. None of the Collateral is presently stored in a commercial warehouse, and none of the Collateral is presently subject to a negotiable xxxxxxx'x xxxx or other negotiable document.
No Warehousing. None of the Collateral shall be stored by a commercial warehouse or shipped under a negotiable document unless Lender is given at least thirty (30) days prior notice to enable it to take such measures as it may deem appropriate to protect its rights in the Collateral to be so stored.
No Warehousing. Advance will be made against an Eligible Loan if the Warehousing Advance will exceed the amount applicable to that type of Eligible Loan at the time it is pledged, as set forth in Exhibit H.
No Warehousing. Advance, other than a Warehousing Advance to repay outstanding loans under the Existing Agreement or a Warehousing Advance against a Repurchased Maturing Mortgage Loan, an Impaired Mortgage Loan or a Mortgage Loan that constitutes a modification resulting from an extension of a Mortgage Loan with a final balloon payment or an adjustable interest rate, shall be made against a Mortgage Loan closed more than 90 days before the date of such Warehousing Advance.
