Contractor shall not be liable for, and United releases Contractor from, any liability for any flight cancellation or delay, to the extent it results from any malfunction in or interruption of Apollo Services or the Automation Equipment; and, notwithstanding any other provision hereof, no such cancellation or delay shall be included in any performance calculation relating to operating goals except for occasions to the extent such failure is the result of Contractor’s own misuse or negligence.
No Warranty; Release. The Holder makes no claim of suitability for the Hardware, and the Maker affirms that it has properly investigated the Hardware and its suitability for use in its intended purpose. The Holder makes no warranty of any kind or nature whatsoever, express or implied, with respect to the Hardware or the Public Safety System including, without limitation, any representation or warranty of service, performance, or fitness for a particular purpose. You agree and acknowledge that SAG Awards has not made any warranty or representation whatsoever, express or implied, with respect to the SAG Awards Program or any SAG Awards Clips, Recordings, Stills and/or SAG Awards Stills, or your use of them.
