Common use of Nomination Clause in Contracts

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the Apartment, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner and the Promoter. • The Allottee shall pay an additional legal fee of Rs. 10,000/- (Rupees ten thousand only) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits Allottees admit and accepts accept that before the execution and registration of conveyance deed of the ApartmentSaid Apartment And Appurtenances, the Allottee Allottees will be entitled to nominate, assign and/or transfer the Allottee’s Allottees‟ right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter per clause 20 subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : 12.1. The Allottee Allottees shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. • The Allottee Allottees shall obtain prior written permission of the Promoter and the Allottee Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. 12.3. • The Allottee Allottees shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s Promoter‟s legal advisors towards the tripartite Nomination AgreementAgreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nomination. 12.4. • Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee Allottees shall be entitled to nominate, assign and/or transfer the Allottee’s Allottees‟ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

(b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

(c) The Allottee Allottees shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nomination. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee Allottees shall be entitled to nominate, assign and/or transfer the Allottee’s Allottees’ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

(d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. (c) The Allottee Allottees shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee Allottees shall be entitled to nominate, assign and/or transfer the Allottee’s Allottees’ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Unit And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Bungalow And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

The Allottee admits and accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the ApartmentSaid Apartment And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Transferor and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Ltd nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee Allottees shall make payment of all dues of the Promoter Owners/Promoters in terms of this Agreement, up to the time of nomination. • . (b) The Allottee Allottees shall obtain prior written permission of the Promoter Owners/Promoters and the Allottee Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • Owners/Promoters. (c) The Allottee Allottees shall pay an additional legal fee of Rs. 10,000/- Rs.20,000/- (Rupees ten thousand onlyTwenty thousand) to the Promoter’s Owners/Promoters’ legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter Owners/Promoters and subject to the above conditions, the Allottee Allottees shall be entitled to nominate, assign and/or transfer the Allottee’s Allottees’ s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Flat And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 23% (two three percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. (ii) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Co-Lessee and the Promoter. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Flat And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 23% (two three percent) of the market price prevailing at that time (to be determined by the PromoterVendor) as nomination charge to the Promoter Vendor subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter Vendor in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter Vendor and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • Vendor. (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the PromoterVendor’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter Vendor and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. SCHEDULE ‘H’ (Common Expenses) 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the Said Unit/Apartment, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 24% (two four percent) of the market price prevailing at that time or sale price, which is higher (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: •  The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. •  The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. •  The Allottee shall pay an additional a legal fee of Rs. 10,000/- 15,000/- (Rupees ten thousand onlyFifteen Thousand Only) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. •  Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Apartment And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. (e) The Allotte shall not nominate his/her/their right to the Said Apartment before completion of 18 (eighteen) months from the date of execution of the Agreement for Sale. SCHEDULE ‘G’ 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Apartment And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. 6th Schedule (Common Expenses/Maintenance Charges)

Nomination. The Allottee Allottee/Transferee admits and accepts that before the execution and registration of conveyance Transfer deed of the ApartmentSaid Unit And Appurtenances, the Allottee Allottee/Transferee will be entitled to nominate, assign and/or transfer the AllotteeAllottee’s/Transferee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee Allottee/Transferee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee Allottee/Transferee shall obtain prior written permission of the Promoter and the Allottee Allottee/Transferee and the nominee shall be bound to enter into a tripartite agreement with the Owner Transferor and the Promoter. • . (c) The Allottee Allottee/Transferee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee Allottee/Transferee shall be entitled to nominate, assign and/or transfer the AllotteeAllottee’s/Transferee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. S CHEDULE ‘G’

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of Sub Lease/Transfer/Assignment of the ApartmentSaid Unit And Appurtenances but not before 12 (twelve) months from the date of execution of this Agreement, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% Rs.100/- (two percentRupees one hundred) of the market price prevailing at that time (to be determined by the Promoter) per square feet as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned following conditions: • : 9.1 The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . 9.2 The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner and the Promoter. • . 9.3 The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors Legal Advisors towards the tripartite Nomination Agreement. • . 9.4 Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer nomination charge.

Nomination. The Allottee admits Allottee/s admit/s and accepts accept/s that before the execution and registration of conveyance deed of the ApartmentSaid Flat And Appurtenances, the Allottee Allottee/s will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the PromoterPromoters) as nomination charge to the Promoter Promoters, if the cancelation is done beyond 15 (fifteen) days from the date of execution of this Agreement, subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee Allottee/s shall make payment of all dues of the Promoter Promoters in terms of this Agreement, up to the time of nomination. • . (b) The Allottee Allottee/s shall obtain prior written permission of the Promoter Promoters and the Allottee Allottee/s and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • Developer. (c) The Allottee Allottee/s shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s Promoters’ legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter Promoters and subject to the above conditions, the Allottee Allottee/s shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. 8th Schedule (Common Expenses)

The Allottee admits and accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the ApartmentSaid Apartment And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Transferor and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- /- (Rupees ten thousand only) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. The Allottee admits and accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the ApartmentSaid Apartment And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the PromoterTransferor) as nomination charge to the Promoter Transferor subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter Transferor in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter Transferor and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Transferor and the Promoter. • Transferor. (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Transferor/Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Transferor/Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

The Allottee admits and accepts that before the execution and registration of conveyance Transfer deed of the Apartment, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Co- Lessee and the Promoter. • . (c) The Allottee shall pay an additional legal fee of RsINR. 10,000/- [•] (Indian Rupees ten thousand only[•]) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits and accepts that before the execution and registration of conveyance deed of the Apartment, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • The Allottee shall pay an additional legal fee of Rs. 10,000/- (Rupees ten thousand onlythousand) only to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. The Allottee admits Allottees admit and accepts accept that before the execution and registration of conveyance deed of the ApartmentSaid Bungalow And Appurtenances, the Allottee Allottees will be entitled to nominate, assign and/or transfer the Allottee’s Allottees’ right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee Allottees shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee Allottees shall obtain prior written permission of the Promoter and the Allottee Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee Allottees shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. 6th Schedule (Common Expenses/Maintenance Charges)

Nomination. The Allottee admits Transferees/Allottees admit and accepts accept that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the ApartmentSaid Unit And Appurtenances, the Allottee Transferees/Allottees will be entitled to nominate, assign and/or transfer the Allottee’s Transferees/Allottees’ right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the PromoterPromoters) as nomination charge to the Promoter Promoters subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee Transferees/Allottees shall make payment of all dues of the Promoter Promoters in terms of this Agreement, up to the time of nomination. • . (b) The Allottee Transferees/Allottees shall obtain prior written permission of the Promoter Promoters and the Allottee Transferees/Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owner Transferor and the Promoter. • Promoters. (c) The Allottee Transferees/Allottees shall pay an additional legal fee of Rs. 10,000/- (Rupees ten thousand onlythousand) to the Promoter’s Promoters’ legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter Promoters and subject to the above conditions, the Allottee Transferees/Allottees shall be entitled to nominate, assign and/or transfer the Allottee’s Transferees/Allottees’ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

Nomination. (d) Subject to the approval and acceptance of the Promoter and Promoterand subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.

The Allottee admits and accepts that before the execution and registration of conveyance deed of the ApartmentSaid Flat And Appurtenances, the Allottee will be entitled to nominate, assign and/or transfer the Allottee’s Allottee‟s right, title, interest and obligations under this Agreement on payment of 23% (two three percent) of the market price prevailing at that time (to be determined by the Promoter) as nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: • : (a) The Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. • . (b) The Allottee shall obtain prior written permission of the Promoter and the Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owner Owners and the Promoter. • . (c) The Allottee shall pay an additional legal fee of Rs. 10,000/- Rs.10,000/- (Rupees ten thousand onlythousand) to the Promoter’s Promoter‟s legal advisors towards the tripartite Nomination Agreement. • . (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottee shall be entitled to nominate, assign and/or transfer the Allottee’s Allottee‟s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.
