NON-APPLICATION OF CERTAIN LAWS. The Pueblo, TVAA, and Acequias agree that, pursuant to subsection (E) of XXXX 0000, § 72-5-24.1 (2003), the other provisions of that statute do not and shall not apply with respect to Pueblo acquisition, transfer, and retirement of surface water rights under this Settlement Agreement.
NON-APPLICATION OF CERTAIN LAWS. Landlord and Tenant agree that the provisions of this Section 13 and the remaining provisions of this Lease shall exclusively govern the rights and obligations of the parties with respect to any and all damage to, or destruction of, all or any portion of the Premises or the Project, and Landlord and Tenant hereby waive and release each and all of their respective common law and statutory rights inconsistent herewith, whether now or hereinafter in effect (including, without limitation, Sections 1932(2) and 1933(4) of the California Civil Code, as amended from time to time).
