Non-Chairperson Compensation and Expenses. The compensation and expenses of the arbitrator appointed by CONTRACTOR shall be borne and paid solely by CONTRACTOR. The compensation and expenses of the arbitrator appointed by AGENCY shall be borne and paid solely by AGENCY. CONTRACTOR and AGENCY shall each bear and solely pay its own costs and attorney's fees, expert and other witness fees and other expenses incurred in the preparing and prosecuting their respective cases. In proceedings where the record of a public hearing of AGENCY Board of Directors is to constitute by the arbitration panel, the costs of transcribing, typing and copying the record shall be borne and paid equally by CONTRACTOR and AGENCY.
