Common use of Non-Compliance with Other Provisions Clause in Contracts

Non-Compliance with Other Provisions. The Borrower shall: (a) fail to perform or observe any covenant contained in Section 9.1.5(c) of this Agreement, (b) fail to perform or observe any covenant contained in Section 9.2 of this Agreement, and such failure shall continue for three (3) Business Days, or (c) fail to perform or observe any other term, covenant or agreement contained in this Agreement or any other Transaction Document on its part to be performed or observed and, except as provided in Section 10.2.2, any such failure shall remain unremedied for thirty (30) days.
