Common use of Non-Disturbance Clause in Contracts

Non-Disturbance. Tenant’s obligation to subordinate its interests or attorn to any mortgagee is conditioned upon the mortgagee’s agreement not to disturb Tenant’s possession and quiet enjoyment of the Premises under this Lease so long as Tenant is in compliance with the terms of the Lease. Landlord represents and warrants that there are no mortgages or deeds of trust currently encumbering the Office Complex or the land on which the Office Complex is located.

Non-Disturbance. Tenant’s obligation to subordinate its interests to any mortgage or ground lease, and to attorn to any mortgagee Successor, is conditioned upon the mortgagee’s agreement , ground lessor, or Successor agreeing to not to disturb Tenant’s possession and quiet enjoyment of the Premises under this Lease during the Term so long as Tenant is not in compliance with default under the terms of the this Lease. Landlord represents and warrants that there are no mortgages or deeds of trust currently encumbering the Office Complex or the land on which the Office Complex is located.

Tenant’s obligation to subordinate its interests in this Lease or attorn to any mortgagee is conditioned upon the mortgagee’s agreement (by way of a separate instrument) not to disturb Tenant’s possession and quiet enjoyment of the Premises under this Lease so long as Tenant is in compliance with the terms of the Lease. Landlord represents and warrants that there are no mortgages or deeds of trust currently encumbering the Office Complex or the land on which the Office Complex is located.

Non-Disturbance. Tenant’s obligation to subordinate its interests or attorn to any mortgagee is conditioned upon Tenant’s receipt of the mortgagee’s agreement in written, recordable form not to disturb Tenant’s possession and quiet enjoyment of the Premises under this Lease so long as Tenant is in compliance with the terms of the Lease. Concurrently with Landlord’s execution of this Lease, Landlord represents and warrants that there are no mortgages or deeds of trust currently encumbering shall obtain a nondisturbance agreement substantially in the Office Complex or the land on which the Office Complex is locatedform attached hereto as Exhibit E for Tenant’s benefit from Landlord’s current mortgagee.
