Non-Duplication and Exclusivity of Participation. A. The ACO may not participate in any other Medicare shared savings initiatives, except as otherwise specified by CMS, as described in Appendix R. B. CMS waives the non-duplication requirements under section 1899(b)(4)(A) of the Act and in the implementing regulations at 42 CFR § 425.114(a) and (b) regarding participation in a model tested under section 1115A of the Act that involves shared savings as they apply to Preferred Providers, subject to the conditions and requirements set forth in Appendix R.
