Non-Exclusive Extension Sample Clauses

Non-Exclusive Extension. At the end of the Initial Exclusivity Period, if Stryker does not elect to extend the exclusive rights granted to Stryker under this Agreement in accordance with Section 2.3(b), then Stryker may, at its sole option, extend the Term on a non-exclusive basis for a period of two (2) years from the end of the Initial Exclusivity Period, by paying Osiris the Non-Exclusive Extension Fee (as determined pursuant to Section 6.3), if any, on or before the last day of the Initial Exclusivity Period. In the event Stryker elects to extend the Term on a non-exclusive basis, Sections 2.1, 2.4, and 4.1 will become non-exclusive and the following terms in this Agreement will no longer apply: Section 2.3, Section 2.4(c), Section 5.6, Section 7.1 and Section 8.4.
