Common use of Non-Existence of Other Agreements Clause in Contracts

Non-Existence of Other Agreements. (a) Other than as permitted by Section 8.14 and Section 8.21, (i) the Issuer is not a party to any contract or agreement of any kind or nature and (ii) the Issuer is not subject to any obligations or liabilities of any kind or nature in favor of any third party, including, without limitation, any Contingent Obligations.

Non-Existence of Other Agreements. (a) Other than as permitted by Section 8.14 8.21, Section 8.23 and Section 8.218.31, (i) the such Issuer is not a party to any contract or agreement of any kind or nature and (ii) the such Issuer is not subject to any obligations or liabilities of any kind or nature in favor of any third party, including, without limitation, any including Contingent Obligations.

(a) Other As of the date of the issuance of the first Series of Subordinated Notes, other than as permitted by Section 8.14 and Section 8.21, 8.23 hereof (i) the Issuer is not a party to any contract or agreement of any kind or nature and (ii) the Issuer is not subject to any obligations or liabilities of any kind or nature in favor of any third party, including, without limitation, any Contingent Obligations.
