Common use of Non-Impairment Clause in Contracts

Non-Impairment. Except as expressly provided herein, nothing in this Amendment shall alter or affect any provision, condition, or covenant contained in any of the Loan Documents or affect or impair any rights, powers, or remedies of Lender, it being the intent of the parties hereto that the provisions of the Loan Documents shall continue in full force and effect except as expressly modified hereby.

Non-Impairment. Except as expressly provided herein, nothing in this Amendment shall alter or affect any provision, condition, condition or covenant contained in any of the Note or other Loan Documents Documents, or affect or impair any rights, powers, or remedies of Lenderthereunder, it being the intent of the parties hereto that the provisions of the Note and the other Loan Documents shall continue in full force and effect except as expressly modified hereby.

In the event of any conflict or discrepancy between this Amendment and the Credit Agreement, this Amendment shall control.

Nothing contained herein shall serve to waive any of Lender's rights or remedies as a result of Borrower's non-compliance with any provision of the Loan Agreement or the Loan Documents either before or after the date hereof.
