Non-Infringement of Rights by Third Parties. To Allos’ Knowledge, no Third Party is infringing or has infringed the Allos Technology or the Allos ISS Technology or is misappropriating the Allos Manufacturing Know-How existing as of the Effective Date;
Non-Infringement of Rights by Third Parties. To Aravive’s knowledge, no Third Party is infringing or has infringed the Aravive Technology as of the Effective Date;
Non-Infringement of Rights by Third Parties. To Seres’ Knowledge, no Person is infringing or threatening to infringe the Licensed Patents or misappropriating or threatening to misappropriate the Licensed Know-How by reason of the Exploitation of products utilizing the Microbiome Technology in the Field. Neither Seres nor any of its Affiliates has received any written notice of any unauthorized use, infringement, misappropriation, or dilution by any Person, including any current or former employee or consultant of Seres or its Affiliates, of any of the Licensed Patents or Licensed Know-How with respect to the Microbiome Technology.

Non-Infringement of Rights by Third Parties. To Foamix’s knowledge, no Third Party is infringing or misappropriating, or has infringed or misappropriated the Foamix Technology as of the Effective Date;
Non-Infringement of Rights by Third Parties. To GlycoMimetics’ knowledge, no Third Party is infringing or has infringed the GlycoMimetics Licensed Patents as of the Effective Date;
Non-Infringement of Rights by Third Parties. To Keros’ knowledge, no Third Party is infringing or has infringed the Keros Licensed Patents as of the Effective Date; and
Non-Infringement of Rights by Third Parties. To Inovio’s actual knowledge, no Third Party is infringing or has infringed the Inovio Product-Specific Licensed Patents as of the Effective Date;
