Non-Judicial Enforcement. Provided that there is no breach of the peace, the Subordinated Noteholder Representative may enforce its rights hereunder without prior judicial process or judicial hearing, and to the extent permitted by and carried out in accordance with applicable law, each Pledgor expressly waives any and all legal rights which might otherwise require the Subordinated Noteholder Representative to enforce its rights by judicial process. 18
