Common use of Non-Monetary Judgments Clause in Contracts

Non-Monetary Judgments. Any non-monetary judgment, order or decree shall be rendered against the Borrower or any of its Subsidiaries which does or has a reasonable likelihood of having a Material Adverse Effect and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order or (B) there shall be any period of ten consecutive days during which a stay of enforcement of such judgment, order or decree, by reason of a pending appeal or otherwise, shall not be in effect;

Non-Monetary Judgments. Any non-monetary judgment, judgment or order or decree shall be rendered against the Borrower or any of its Subsidiaries which does or has by a reasonable likelihood court of having competent jurisdiction that could be reasonably expected to have a Material Adverse Effect Effect, and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order is not satisfied, discharged, vacated, bonded or (B) there shall be any stayed pending appeal within a period of ten 60 consecutive days during which a stay of enforcement of such judgment, order or decree, by reason of a pending appeal or otherwise, shall not be in effect;days; or

Non-Monetary Judgments. Any non-monetary non-interlocutory judgment, order or decree shall be rendered is entered against the Borrower or any of its Subsidiaries which does or has a reasonable likelihood of having could reasonably be expected to have a Material Adverse Effect Effect, and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order or (B) there shall be any period of ten 20 consecutive days during which a stay of enforcement of such judgment, order judgment or decreeorder, by reason of a pending appeal or otherwise, shall not be in effect;; or

Non-Monetary Judgments. Any non-monetary judgment, order or decree shall be rendered is entered against the Borrower or any of its Subsidiaries which does or has would reasonably be expected to have a reasonable likelihood of having a Material Adverse Effect material adverse effect with respect to Borrower, and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order or (B) there shall be any period of ten 30 consecutive days during which a stay of enforcement of such judgment, order judgment or decreeorder, by reason of a pending appeal or otherwise, shall not be in effect;, or any action shall be legally taken by a judgment creditor to levy upon assets or properties of Borrower to enforce any such judgment; or

Non-Monetary Judgments. Any non-monetary judgment, order or decree shall be rendered against Borrower, the Borrower REIT, any of their Subsidiaries or any of its Subsidiaries which does Management Entity that has or has a reasonable likelihood of having would reasonably be expected to have a Material Adverse Effect Effect, and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order or (B) there shall be any period of ten (10) consecutive days during which a stay of enforcement of such judgment, order judgment or decreeorder, by reason of a pending appeal or otherwise, shall not be in effect;; or

Any non-monetary judgment, judgment or order or decree shall be rendered against the U.S. Borrower or any of its Subsidiaries which does or has by a reasonable likelihood court of having competent jurisdiction that could be reasonably expected to have a Material Adverse Effect Effect, and either (A) enforcement proceedings shall have been initiated by any Person upon such judgment or order is not satisfied, discharged, vacated, bonded or (B) there shall be any stayed pending appeal within a period of ten 60 consecutive days during which a stay of enforcement of such judgment, order or decree, by reason of a pending appeal or otherwise, shall not be in effect;days; or

Any non-monetary judgment, order or decree shall be rendered against the Borrower or any of its Subsidiaries which does or has a reasonable likelihood of having would reasonably be expected to have a Material Adverse Effect Effect, and either (A) enforcement proceedings the same shall have been initiated by any Person upon such judgment or order or (B) there shall be any remain unsatisfied, unvacated and unstayed pending appeal for a period of ten consecutive forty-five (45) days during which a stay of enforcement of such judgment, order or decree, by reason of a pending appeal or otherwise, shall not be in effect;after the entry thereof; or
